  • WARRANTIES OF NON-INFRINGEMENT
  • WARRANTIES OF ACCURACY, RELIABILITY, OR COMPLETENESS
  • WARRANTIES OF UNINTERRUPTED OR ERROR-FREE OPERATION

5.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MKTS DATA LLC d/b/a TickersData, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUBSIDIARIES, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Investment losses, trading losses, or financial damages
  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Loss of use or access to systems or services
  • Business interruption or operational disruptions
  • Emotional distress or reputational harm
  • Costs of substitute services or products
  • Attorney’s fees and litigation costs

5.3 Maximum Liability Cap

IN NO EVENT SHALL TICKERSDATA’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO TICKERSDATA FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100.00).
